How do you determine if an enemy can hit the side arc? Is it just which ever arc of the tank the enemy is currently in? Or do they use line of sight?

its both LOS and range ruler base.
LOS is only used to determine if they can see the side arc area like if a building is blocking them seeing that part..
page 34 covers firing arc but it applies to all arc releated issues
To determine each of the edges of a unit’s firing arc, a player
aligns the edge of the range ruler with the firing-arc line on
a unit’s base to create one continuous line
If any part of a mini’s base is inside a firing arc, that mini’s
unit is inside that firing arc
so from the tank put a range ruler to along the arc line if they fall inside the side arc area and isn't obscured by a building they gain the benefit.

A clarification: Not "they" need to be in the side arc area. The unit leader of the attacking unit must be in the tanks side arc measured from the tank.
