Remy and Foundation Destruction

Here is the scenario...

1. I'm playing Remy and I have 1 Chester's Backing out. I choose to attack and play a throw. I play his second E which says...

"E Commit: If your attack deals damage, destroy a foundation that has more than 1 copy in play in your opponent's staging area."

2. My opponent has 1 CB as well and chooses to block, take it, rejection it or whatever but the attack does connect.

Am I able to destroy my opponent's CB or does my opponent have to have 2 CBs for me do kill one? I'm fairly certain that it would be the latter but the question did come up so I wanted to ask.

His ability specifically stats more than one in your opponents staging area. Cards like Charlies fierce punch have a disclaimer that say in play with would count cards in your staging areas as well as your opponents

speaking of which does in play count the card pool as well?

I assume it does but if i have a card that is a copy of a card in my opponents staging area and then play charlies fierce punch can i destroy the copy in my opponents staging area?

yes - but CFP is not the same as remy, who specifies in the staging area.
