say i have won a miliatary on house stark and he has chosen bastads elite for the claim .whilst this card is in moribund can i take control of BE by using its passive response in step 4 of the framework action window or because it is moribund can i no longer take control of it

Of course, taking control of it doesn't change the fact that it is still moribund. It will be removed from play (and put in the owners dead pile) when the window closes. But the control change still takes place while the character is moribund.
