if i have a character that says it does not kneel to attack/defend, and it is knelt by some other means, can i (declare him to) attack/defend with him while he is kneeling?

No. You cannot declare kneeling characters as attackers or defenders unless it is specifically allowed by a card effect (see Core Set rules, page 13/14).
