A bit confused, might you guys/gals help a bit, please?

1. When using Command Points to increase a Characteristic, can the Characteristic go up beyond its' maximum (printed on the Character log)?

2. Can Overwatch be only activated by spending Command Points?

1: Yes the characteristic may be increased beyond what is printed on the card, i.e. you can make John's Combat Value a 7 by spending a CP.

2: There are some tokens that allow for "free" overwatch, like John's Medal of Honor, Gorgei's Gold Star, and the Schocktruppen's Mechanized Arm. See the Revised Rules for details, because the medals work a little different than the arm.
