I believe so, yes.

On the contrary, it doesn't. It is simply a check that reduces the penalties according to the result achieved. The roll is hard enough by itself, sowith high penalties it would be impossible. It doesn't mention in the abilities' description that it takes the penalties, so I assume it doesn't.
