I like your point of view more. It is better thematically and it fixes a number of mechanical issues with the herald. I am going to change "lose" to "spend" in this these cases.
Problem(s) solved. Mostly.
I used to be a magic the gathering player (well i'm still but a lot more less) and i try to think the "magic-way" for the wording of the card. That's why i was seeing a "spent", a price to pay in that card, instead of a "lose".
In fact, i would say that if you prevent the loss with the Statue, you would gain nothing...
