Who is the Attacker with Hermetica Occulta?

When Heizinger is using Hermetica Occulta, non-OK characters cannot enter his Path without first winning a Mental Duel.

Who is the Attacker in this Duel? Is it Heizinger, because it's HIS spell that's causing the Duel, or the other character, since it was THEIR choice to enter Heizinger's path that initiated the Duel?

It matters since ties result in the Defender winning the Duel.

Not very clear in the rules, but I think it is Herman that initiates an attack on the character who tries to enter the same path. That´s how I play it anyway.

I agree with drap. Hermann should be the attacker.

Closer examination of the text makes it clear that the person trying to enter Hermann's Path is the Attacker and Hermann is the Defender:

Occult, Hermetica • Any character lacking the Obscura Korps unit affiliation symbol who wishes to move into a circle on your path must win a Mental duel (which does not require an action) against you first.
Losing the duel does not prevent that character from continuing his movement, it simply prevents him from moving into a circle on your path. A given character may only initiate this Mental duel once per activation. This duel must be fought each time a character wishes to enter into a circle on your path.

The person moving onto the Path is "initiating" the Duel. In the Glossary, Attacker is defined:

Attacker: The character that initiates a duel, or is targeting an character with an attack.

So, it appears clear that Herman is NOT the Attacker.

I should have looked more closely sooner. Duh.
