In Legion terms, 1 merc commander to 1 to 3 merc troops, Opens possibilities for a Special crew (or two), and some heavy kit (all old CW kit that's been kit-bashed, or new Imp kit that's been kit-bashed).
That way the Mercs are open to both sides 9as I'm sure they were inclined to do.
This design would water down the uniqueness of both sides in my opinion. If any of the mercenary units are particularly good, or offer a type of trooper otherwise unavailable (such as Mandalorian Jump Troopers) then more and more lists on both sides will contain those units. Then the game (especially at this model count/points as opposed to 40k's 2000 point armies and large unit) becomes different minor flavors of Merc.

There's about million good ways to prevent that. I think that it's weird that past Star Wars games roped off big swathes of the galaxy and let anyone hire them in any combination. WTF are tusken raiders and ewoks simultaneously helping the empire for in D20, for example? Cause that was legal in that game. Weird, but legal.
I would prefer that scum be it's own faction. Star wars is particularly rich with it's portrayal of the criminal underbelly of the galaxy. There's the big 6 bounty hunters from empire, jabba and his minions, half of mos eisley, kanjaklub and guavian death gangers from force awakens, Hondo and his pirates.... there is a lot of source material.

If droids are sentient (debatable) we're more than mere owners. We're the gods of their universe.
IMo there should be lots of factions down the line to keep this game fresh.
Imperials and Rebels both can have small skirmishes with numerous 'scum ' types.
Gangsters
Planetary defence forces
Crime syndicates
Beasts?
Watching rebels atm. Half the time they arnt shooting at stormtroopers...I hope Legion dosnt limit itself to just those 2 'sides' down the line(I include CW there too...lets face it...Republic vs Empire isnt going to make much sense...certainly much less sense than Rebels/imps/Republic/Separatists vs gangsters/scum

That's on the players who chose to play those match-ups. A game like this should require people to sign up ahead of time for light side/dark side at tournaments and get paired off accordingly.

The newly formed Storm Trooper Corp are sent to hunt down a faction of Republic Army who have rebelled and refused to become part of the Empire, ala rex, wolf.
The Kaminoians, fearing being taken over by the empire, breed clones loyal to them. The Empire comes a knocking.
Clones on a deep space recon mission return to find the empire ascendant. Removing their chips they follow their Jedi master in attacking an Imperial facility.
Little imagination and you can easily come up with game scenarios that fit.
Rebel on clone- A planet defects to the Separatists and the clones are sent to battle its defence force and bring them back.
Empire versus droids- An imperial scout mission uncovers an old abandoned Separatist base, as they enter the base, its defence and droids re activate. Hilarity ensues.

So what happens when you have significantly more players for Rebels sign up than for the Empire? Such a restriction is best suited for cinematic events, not competitive tournaments. Historical gamers are often significantly more worried about playing opposing factions yet even there I haven't heard of the pairing being strictly based upon Axis vs Allied as opposed to standing based matchmaking. Bolt Action tournaments also frequently have awards for "best Allied general" and "best Axis general" as a separate award from best overall standing.

The idea that it's not suited to competitive tournaments falls flat with me. If anything that does more to reveal the fundamental folly of having competitive tournaments for this entire category of hobby. There's a lot of solutions, that have been put into practice in the past for various game systems. You have to get organized a little further in advance, and/or you might have to own two factions as a player.
