Yes, we are certain. Someone third party did a full kit leak on reddit including the components page so we know he is not there.
the content list does not include the separate bag of new wave one 2ndE content which is also in the kit. He could be in there. But he may not be coming until a later wave.

Well obvs he'll be there when they account those factions WHICH THEY'RE GOING TO DO ANY DAY NOW RIGHT FFG?, but that would still mean Rebel players buying a CIS expansion.
He'll be in the Ghost/Sheatipede re-release, which means (based on what they've said) you can just buy the card conversion pack and have Maul that way.
There's no reason he would be in the extra Wave 1 baggie, as he isn't in any of the Wave 1 ships.

I m in the same boat really. Practically it's irrelevant for me where Maul is as I'm getting all 3 conversion kits anyway, but the situation somewhat upsets me because it confirms some reservations I had (that 'you don' t need to collect all factions' is more marketing talk than fact).

That will be in how many months? We don't know. Until the as a Rebel player your options are buy the Scum kit, secondary market or wait. What if the top Rebel squads end up including Maul? (think 1.0 Interceptors and Autothrusters).
To further elaborate my point. I feared that FFG would not be committed to releasing all cards to all factions at the same time, which Maul seems to confirm. This means that, if you want/need a given card that hasn't yet been released for your faction, you will need to buy cross-faction, go to the secondary market or wait. Not a huge deal but a negative point in my book.

...You make a squad to counter Maul or mess with his strategy? Take Sabine crew and use bombs to hand out stress tokens so the Maul ship is double stressed, for example. I don't know why people reach for the top squads, instead of trying to subvert them.

This has already been seen in Runewars and Legion, so it doesn't surprise me in the least for X-wing Second Edition. The three options you listed are absolutely right. I intended to only run one faction in Runewars, but it's so cool that I've picked up 3 out of the 4. I anticipate this will happen for many people with X-wing. For those who don't pick up other factions, you can either spend your money to have it now, or spend your time to have it later - it's all on the same spectrum.

As I don't play either, for me it was a slightly unpleasant surprise. Not a big deal as I said, just a small negative in the context of their 'promise'.
