okay so lets say you have rolled and it puts you on another character,,,and you hit them with toadify,,,and then they counter with involunerability. does the toadify still go off,,,but the toaded character can't be attacked?? or do you first have to do the toadify,,and if it is successful,,,then the toad isn't able to cast a spell????

I would say the attacker declares they are encountering the other character. That character can then Evade. If he doesn't Evade, then cast Toadify.
well the attacker is still going to try and encounter the character,,and cast his spell first,,with the toadify,,,even if the character evades,,,doesn't the toadify still go off??

If the attacker cast toadify, before the defender cast evade, then toadify comes first..
It depends who is faster with playing cards 
But you have nothing to lose,... if the defender cast a quick evade spell, then try to land on him again and cast the toadify spell.

Evading comes first, since Toadify is cast "when about to engage in battle" (or something like that). Not a question of who is quicker off with the card out of hand IMO. You encounter character, when you declare you are attacking the char, they have the window to evade (step 1 under combat sequence). If they pass, then zap Toadify.
I do feel the timing sequence for spells in battle should get clarified, as well as when a battle actually begins. To my reading of the rules, battle doesn't begin until the Evade step is passed, only at that point can you start casting combat-related spells (during step 2 of the combat sequence).

Yes, evading comes first, but that is for characters who has the evading ability.
step 2 is spells. Someone can play quick a toadify spell, before the other player cast the evade spell. ( both are spells)

I would definately say even Evade by Spells is step 1. Step 2 is related to Spells that will impact the stats the characters will use in combat. Note how step 1 specifically points to page 14 and its Evade rules (which mention Evade by Spells).

A: As a general rule, any effects or abilities that allow a character to evade must be resolved first, before any other Spells or abilities are used. You cannot for example, cast Finger of Death on your opponent and then cast Cloak of Shadows to evade him.
