Jet Trooper Fly-By

So there is a discussion on facebook about 0-0-0. In the discussion it was established that with invasive procedure even if you are not adjacent to any figures you still resolve the second part of that action which reads "You become focused."

This led to a discussion of the Jet Trooper "Fly-By" ability. There are two separate parts of this ability that is triggered "when you declare an attack..." Should you gain the two movement points when you declare an attack regardless of whether or not you are within 2 spaces of the target? Someone made it seem as if this has already been ruled on, suggesting that if your target is more than 2 spaces away you don't get the movement. If it's the case that you don't get the movement how is that different than 0-0-0 focusing himself?

You can look up the discussion in these forums.

The gist of it is that "the attack" refers to a specific attack - the attack with the blue die. And it has been ruled by FFG to be so. (If it applied to all attacks, it would be "After you resolve an attack, gain 2mp." and it would be a separate ability.)
