Vader and simultaneous fire

By verizonwired, in X-Wing Rules Questions

Ok so everyone knows how Vader works with Gunner. My question is:

If a ship with Vader has 3 hull points left and is a PS10 is destroyed by another ship with PS10 but that player has initiative, you are allowed to shoot back because of the simultaneous fire. Thus, are you allowed to Vader, once for the first shot, and twice if needed to use gunner?

Would that mean the ships with Vader will receive 7 damage, 3 from the player destroying it and 4 from Vader?

or would you just not be allowed to use Vader?

Basically I'm bring up the question of, when is damage actually applied when there is simultaneous fire. If its applied at the same time after both players shoot, there is no incentive not to use Vader. If the damage is applied after the player with initiative shoots, then there really is no simultaneous fire and the destroyed ship should not be allowed to fire back.

The FAQ states that all effect remain in play, but when is hull taken into account?

You can't use Vader if you're out of hull, so he won't work in a Simultaneous Fire situation.

The FAQ says you can't use Vader if you have no hull remaining.

Now this just IGNORES the fact that a ship's hull rating never changes (outside of adding a Hull Upgrade) which means there should be nothing stopping you from being on a ship surviving due to Simultaneous Fire rules and then shooting-Vader-miss-Gunner-Vader. That isn't how the FAQ is meant to be interpreted where it somehow figures that damage cards actually lower hull when they do not; it's just that the rules say a ship is destroyed when damage card numbers meet or exceed a ship's hull rating.

In a simultaneous fire situation damage is applied as it is taken. If you have two ships at the same PS the first one to shoot gets to put all of its damage cards on the second ship before the second ship will get its parting shots. This is important because sometimes those cards will be face-up and have a big impact on how useful that second attack could be. Suffer the crit that prevents attacks and while that second ship will remain on the board until simultaneous fire is resolved it will not be able to attack to utilize that benefit.
