If you are in the UK, the law is clear that your contract is with the shop and they are legally obliged to refund or replace it for (including shipping costs IIRC). You have no contract with the manufacturer so they are not liable.
Not sure what the regulations are in other countries but I would expect the same thing to apply. If a product is faulty on purchase, you normally take it back to the shop.

IF you did happen to purchase it online, a friendly email to the E-store will receive immediate results. There are so many online competitors that a single store simply cannot afford poor feedback, especially about severely defective products. I'd say it would be 50% chance that they send you another pack at their cost, 25% chance they give you a full refund, and 25% chance they let you exchange it at their cost.
They have the legal liability, regardless of where in the world you purchased it (except maybe China). This gives you the leverage when talking to the seller.
