x wing...parts and components non suitable for children under 14...

Quite a little bit too much. When I was 12 I was delighted mixing flamable liquids in my chemistry lab "recomended ages 10+". I only burned myself four or five times...

On my opinion, a "normal" 12 years old boy will not eat a peg. Perhaps a little too restrictive. But the first time visited the USA I was surprised when I read "Caution - Hot" printed on a ready to take away coffe... Those funny lawyers...

Yeah... it won't be some other country that takes us down... it will be the lawyers...

Hahah, I completely agree. The funniest one to me is McDonalds' coffee is on their menu as "Hot Coffee" and they have a sign in every restaurant that says, "Warning, McDonald's hot coffee is hot"

FWIW, the reason is much more mundane.

Because the vast majority of the product parts are imported from China, and China has...let's say a reputation...for using hazardous chemicals in their products , there are laws on the books that anything coming from China designed for play/use by children under 14, have to go through a considerably lengthy and rigorous testing/approval process to make sure there is nothing toxic about it.

So you can either have your products go through that lengthy testing/approval process and be able to be sold 'for children'...or just stick a label on it saying 'not for children under 14', and now the testing doesn't need to happen.

Just for laughts...

If you are in the USA and you play.with your 12 years old son...can somebody start legal actions against you???

Hahah, I completely agree. The funniest one to me is McDonalds' coffee is on their menu as "Hot Coffee" and they have a sign in every restaurant that says, "Warning, McDonald's hot coffee is hot"

The guy who came up with that (Probably the CEO of McDonalds redundancy department) is really the superhero Captain Obvious.

And this how Jack in the box ran with it:

Depends what your playing... :D

Cops and robbers with real guns

Cowboys and Indians (That's native american!)

FWIW, there is a lot more to that 'hot coffee' case than most people realize. In point of fact, McDonalds was indeed implementing dangerous policies to save money that really was putting consumers at risk.

Actually, I would daresay the McDonald's is listed that way because someone sued McDonald's for spilling coffee on themselves... and won. Now it is a disclaimer so they cannot be sued again.

This is the reason McDonalds have a disclaimer on their coffee I believe - Liebeck v. McDonalds Restaurants.

What makes it worse is that you could buy SW micro-machines who were about the same size.

Thank god i live in a country where you can buy Kinder eggs.

I like that the lawyer made more it about the temperature .

Still, cases like this make me wonder if when I fall down, I could sue the decendants of Isaac Newton. :D

Actually, the McDonald's lawsuit happened because the plaintiff in that case got third degree burns on their legs and groin from spilled coffee. Do you guys know what third degree burns are? It means that both the outer layer of skin and the lower level are completely burned, exposing the tissue underneath. This coffe was so hot that it removed a woman's SKIN. Then when you factor in where the burns occurred, the verdict was justified. The coffee was heated to 190 degrees Fahrenheit. That's only 20 degrees below legitimately boiling liquid. No human can safely consume liquid at that temperature, and the coffee was clearly defective because of that temperature. Beyond that, after skin grafts and two years of medical treatment, her initial jury award was reduced significantly, and before an appeal happened, the parties settled confidentially for an amount presumably lower than the 600k reduced award.

And everyone loves to hate on lawyers until they need one...

no but if you let your 12 years old play in your front yard alone they might call child services. plenty of articles about neighbors thinking you have to supervise kids like Big Brother calling child services, and then child services initiates legal actions against the innocent parents. welcome to crazy USA

Still not sure how a liquid can be "defective"...

I'm think I read "contains peanuts" in jars of peanut butter, and "contains milk" in either milk or yoghurt containers.

as a note. "Caution hot" is printed on McDonalds Coffee cups because when it gave an 80 year old woman 3rd degree burns on the bottom half of her body, the tempurature of the coffee in the paper cup that disintergrated (boba fett style) in her had was upwards of 180 degrees, close to boiling. the money she sued for was for pain and suffering, but the court deemed it suitable to add on a sizable amount of money for the surgeris to have skin grafts covered, as well as punative (punishing[ones]) damages. so .... maybe third degree burns is a good enough reason for "Caution hot"

to the above, she did not "spill it on herself" the cup gave out in her hand, causing it to spill in her lap, as it was handed to her.

Still not sure how a liquid can be "defective"...

Well, I spent 3 years and 6 figures to be able to explain that, so if laypeople could, I'd be a little pissed. :-)

In all seriousness though, anything that doesn't serve its intended purpose is "defective" as a legal term of art. Goods, services, contracts, service of process, legal documents, etc...

Lawyers don't often mean defective in the same way laypersons do.

Actually, the jury awarded around $2,700,000 and the court reduced the award to $600,000, saying the initial award was excessive.

My doubt is...you play x wing with your son. He touches the model and he, lets say, eats a peg.

Can The Law punish you because it is not suitable for childs under 14? Sounds crazy but...

No, it's more for issues with a kid eating a peg and getting toxic poisoning from it or something. You (theoretically) have less of a leg to stand on for a lawsuit, as the product is clearly labelled as not being for use by children of that age.

Oh Dear God..... I guess I should stop holding pegs between my teeth when I'm switching out ships and base tokens.

I mean, depending on the circumstances, child protective services may get involved, but if that happens then enough bad **** was already going down that X-Wing wouldn't be the root cause of that. This is a statement meant to limit civil liability and means literally nothing from a criminal aspect.
