can the OL spawn in LoS of a hero transformed to a monkey?

No, he can´t. It is still a hero with all consequences.

thought it's not a hero anymore, just a marker, like all the familiars, and so i can spawn.....

The fact that all heroes are figures (normally) is completely independent of this fact. The familiars (except Boggs) do not generate LoS because they aren't heroes, but again this has nothing to do with the fact that they aren't figures. When a hero is tranformed into a monkey it explicitly changes the rules concerning movement and actions, it does not change the rules concerning LoS. The monkey is still a hero even if he isn't a figure, therefore he generates LoS.
