Space Rocks has apparently been issued a C&D

All that blatant openness may be what has spared them a serious law suit.

Had they been trying to sell these in a stealthy way (obviously trying to stay under the radar) then there would be a valid case for a malicious trade infringement.

But we aren't talking about thoughts, we are talking about a product (property). We are talking about a company making a product derived from the work of another company, without permission to do so.

Come to think of it (and using your username Slasher) That is something matching the level of intelligence of the average teenage party in a slasher movie.

Not convinced, Starship modeler has had an "imperial tri fighter" on sale for sometime. It's an unlicensed scale model of a TIE Defender.

How is that relevant in the Space Rocks case? A show of malfeasance is a much more serious (and actionable) offense.

It's a point of comparison, A model that's "under the radar" so to speak. Compared to being totally overt.

A lack of enforcement against another company does not imply acceptance of Space Rocks' infraction. This is well established in case law.

However, the way a company comports itself (c.f. totally open vs. obfuscation) has a large bearing on how a judge will treat the motion. In this case a C&D is the worst Space Rocks would suffer due to their open marketing.

Any new news on this?

Since they blacked out the dates, it feels like there is definitely some fraud going on here.

I didn't update here, as posted on other posts and really didn't want to be abrasive. But after opening a paypal claim my Frigate did arrive on the post ~ the 28th/29th..

To my knowledge Mine is one of only 3 I know of that hit destination (the other is the aturi cluster guys, and I think beasts of wars).

I really want to know who else got theirs.

There was something on one of the Facebook pages yesterday where someone said they had received a refund.

Think it was the UK/Irl group page.

I applied for a refund from paypal after the C&D went up whenever that was, it was just granted yesterday despite being over 180 days since I ordered mine way back in August. Glad to hear someone got one at least!

If you ordered on August 1, then that was only 156 days ago (counting from today)

I received a refund from PayPal yesterday; very sad as I would rather have had the model, but at over £100 I can't lose that sort of money anyway. If the owner had at least just responded to my emails we could have taken a different route.

Received my refund last week. Thanks to the tanking Canadian dollar I still lost out on about $20 due to conversion. Lesson learned I guess. Like Sbloom141 if they had responded in any way to emails this could have been different as I would have rather had the model.

This makes me sad, I got my hands on 2 of their Nebulon B's and we use them all the time as obstacles in our casual matches. They are the envy of everyone here and the bane of some when they peel into them off a misjudged maneuver and cross the large end bases. I would have loved to see what else they could have come up with.

I also tried to get one but did get a fairly prompt refund.... which I immediately converted into this:
