Need some advice on harassment

I need some help as one of my work colleges is harassing me that bad that after speaking to my Supervisior weeks ago this guy is now pushing the limits again. Im the third person that is being victimised. One already has written out a complaint. The other is to worried to act.

I requested my Supervisior to meet me and fill out a incident report but it's his mate and I don't think it's going to get any better.

Anyone had a similar experience ? Not sure what to do. I'm on night shift and there's no one in HR that I can speak too.

I think I would need more details. Is this a case of someone being annoying, sexual harassment, interfering with your ability to do your job, playing stupid pranks, etc...? Is this a male female situation?

This is a tricky situation. I don't know how useful I could be in that I have never had to deal with a serious workplace issues. Most of my coworkers have been professional. Sure there have been lazy ones, the "I always blame others if something goes sideways" person, the backstabbers, and such. But never when someone was actively harassing me.

Obviously any advice would likely depend on the TYPE of harassment. Also depends somewhat on the people involved. Like if the person is being trying to be playful and it's just bothering you, talking directly to the person about it can sometimes help by making them aware that they are hurting you.

But I suspect this person is deliberately trying to upset you. They probably think it's funny. I think you've gone the right route by filling out an incident report.... but I do think - before you do that - that you need to let the co-worker know what they've done. Give them the opportunity to fix the situation before you put their job in jeopardy.

If it doesn't get fixed, you are going to eventually have to make a choice. Go all the way up the chain - to your boss's boss, and then his/her boss's boss. Or.... if you don't want to rock the boat, simply learn to ignore this individual. I'd hate to suggest you fight this person to get them to shut their mouth.... because that is seldom the answer.

The harassment is bullying. Consistently pushing in our way while working, arguing about our work actions and verbally challenging by negative and condescending towards staff. I brought up a major safety issue that he has created and he continued to repeat it so as to cause a fight. He then followed me back to my accomodation area ( I work away) after work and challenged me. I refused mutiable times and asked him to leave to which he persisted.

He's making a statement right now and so is a third person, I feel as though I'm in deep $&$@ as it's the bosses mate.

I have spoken to the supervisor regarding this a few weeks ago and I have stayed completely away from him but he continued up until tonight as I have acted officially. I'm not sleeping at all.

Are you in a US workplace or can you speak to your union rep?

If you are in a union, I would contact my union rep ASAP. Being that you are in Australia (I looked at your profile) your rules may be different there so tread carefully.

If someone was causing safety issues (I used to work in the electricity generation industry where safety is, literally, a matter of life and death and it is taken VERY seriously) and threatening to fight me, I would start looking for another job. Regardless of how this turns out. You may have burned bridges and you need to protect yourself. You need to get yourself protected by the union, if applicable, and get things documented. Prepare for retaliation and to get the heck out of there.

You can always go to your HR department, they take things like this very seriously, and if your Supervisor won't get involved they'll go over his head. Or you can go to his manager and file a complaint.

Most every HR department has a web page you can use to fill out complaints or otherwise contact them with.

I get the feeling that you are union though. You need to contact your union ASAP. Call them. You pay dues for this exact reason.

My wife is a teacher and a while back she got into a situation with a parent. The union represented her and protected her. It is their job. They will protect you if you let them.

How big is this company? Are we talking hundreds or thousands of employees total? The bigger the company, the better off you will be. In a small company the boss takes care of everything and can do what they want. However, in a large company with a professional HR department, you can get protected.

This site might have some useful information for you. Here's hoping you can get this resolved, and soon. Nobody should have to deal with a co-worker trying to make them miserable.

Superintendent now involved and will speak with him after shift with the crew. Paper work in and I would say HR will be too, small company of around 100 staff that has only been running from May this year, apparently he was sacked from his last site for similar conduct

It´s not pleasant to be forced to take these steps because of bullying. I think it is safe to say all who have posted here sympathize with your cause. Respect as well for hanging in there, with threats that´s never easy.

From what I read I think you are taking the right steps through the superintendent and HR.

Hang in there and avoid fights, they are a no-win for all.

Admittedly, I am curious why the person behaves like this if it already has costed him a job. It seems rather self-destructive eventually. Who is going to hire a guy who gets fired time and again for aggressive behaviour? Not that I expect you to find out, mind you. I am just wondering <_<

Talk to HR (go in especially) and say "he is creating a hostile work environment for me and X people" and they have to act and if they don't, you can threaten to collectively sue the **** out of them.

Thanks for all of the advice, greatly appreciated. Well HR aren't in until Monday so until then it's situation normal according to management. So I guess it's stay low until Monday.

HR are going to want some form of proof or evidence of any actions. Intimidating guys like this can create a lot of enemies, so it shouldn't be too hard to find some witnesses to help corroborate your complaint. Find as many as you can.

I would suggest carrying a notebook and noting anything this turkey does towards you. The fact that the guy is the supervisor's mate, doesn't make him immune to action. If anything, it makes the supervisor an accessory to the bullying. You definitely need to involve HR or higher management as soon as possible. It really concerns me that he followed you home to harass you. This guy has gone past breaking company policies and is now breaking the law. Make sure you tell HR EVERYTHING.

Well I've had my meeting with the superintendent and it went well, he has mutiable complaints against him and HR are being contacted now to decide his fate. Very positive feed back as all of my notes and reports were clear, factual and work related. The personal side also was discussed with interest as there were 3 harassment claims now submitted.

Thank you all again for the feed back, no one should endure being in this environment , we have the right to be safe at home, at work or when in the out side world.
