Rules Question - Backstab

I checked the comprehensive FAQ pdf and did not find the answer to my question.

Can the active player play backstab on an opponent's unit that is battling back after an attack by one of his/her units, or is the unit battling back not considered "attacking" for the purposes of this card?

I'd vote that it is not "attacking" since it can not perform the follow-on actions of an attacking unit like gain ground.

An active player may indeed target an opponent’s unit that is battling back, with a Backstab Lore card.

Richard sometimes like to ruin a person's fun - namely when someone plays the card on you during a battleback and look at the surprise on their face when the card can be played as such.

But remember, only one Lore card played PER turn. So if you already played on earlier that turn, one can't play another.
